Should individual provisions of these terms become invalid, the\nvalidity of the remaining provisions remains una,ected.<\/p>\n<p><b>Rights and Obligations of MATILAN Security Services GmbH<\/b><\/p>\n<ul>\n<li>&nbsp;MATILAN Security Services GmbH is obligated to perform services in accordance\nwith the applicable regulations for the security industry.<\/li>\n<li>&nbsp;While MATILAN Security Services GmbH ensures the proper execution of an\nassignment, it does not guarantee a specific outcome, as results, particularly in\nobservations or investigations, cannot be anticipated or assured.<\/li>\n<li>The deployment of personnel, vehicles, and resources, as well as the manner of\nexecuting the assignment, is at the sole professional discretion of MATILAN Security\nServices GmbH.<\/li>\n<li>MATILAN Security Services GmbH is authorized to delegate the assignment or parts\nthereof to cooperation partners.<\/li>\n<li>MATILAN Security Services GmbH and its cooperation partners commit to\nmaintaining confidentiality regarding all matters related to their activities for the\nclient. Only the client can release MATILAN Security Services GmbH or its partners\nfrom this duty of confidentiality. Reports, assessments, and other written\nstatements about the results of the activities may only be handed over to third\nparties with the client's consent. This confidentiality obligation continues after the\nconclusion of the assignment, except in cases where there is a legal obligation to\nprovide information.<\/li>\n<li>MATILAN Security Services GmbH is authorized to process entrusted personal data\nwithin the scope of the assignment's purpose or to have it processed by third parties.&nbsp;<\/li>\n<li>&nbsp;MATILAN Security Services GmbH ensures data protection in accordance with the\nprovisions of the GDPR.<\/li>\n<\/ul><div><b><br><\/b><\/div>\n<p><b>Rights and Obligations of the Client<\/b><\/p>\n<ul>\n<li>When fulfilling the assignment at the client's immediate business location, the client\nensures that the organizational framework allows for undisturbed work that\npromotes swift progress. The client provides all necessary documents for the\nfulfillment of the assignment in a timely manner without special request and\ndiscloses processes, information, and circumstances relevant to the execution of\nthe assignment. This also applies to all documents, processes, information, and\ncircumstances that become known after the work has commenced. Furthermore,\nthe client must fulfill any legally prescribed information obligations.<\/li>\n<li>The client may use created o,ers, reports, analyses, assessments, and the like only\nfor the purpose of the assignment; in particular, forwarding them to third parties\nrequires the written consent of MATILAN Security Services GmbH.<\/li>\n<\/ul><div><br><\/div>\n<p><b>Fee Agreement<\/b><\/p>\n<ul>\n<li>&nbsp;MATILAN Security Services GmbH is entitled to payment of a fee by the client for\nfulfilling the assignment. Unless a flat fee has been agreed upon, the billing is based\non the tari, list for personnel and material expenses incurred in connection with the\nassignment, including:\no File review\no Meetings\no Assignment preparation\no Travel times\no Conducting investigations and observations, including preparatory measures\n(environmental study)\no Technical operations\no Maintenance\no Reporting\no Evaluation of video, photo, and audio documentation\no Operation of technical equipment\no Communication costs abroad\no Travel and accommodation expenses\no Other expenses of all kinds<\/li>\n<\/ul>\n<ul>\n<li>If, after assigning the order, the client cancels the execution of the assignment or\nparts thereof, the agreed fee remains payable in full, unless cancellation fees have\nbeen agreed upon in writing or MATILAN Security Services GmbH expressly waives\nthe fee. Unless otherwise agreed, the client is also required to make ongoing\nadvance payments.<\/li>\n<\/ul>\n<ul>\n<li>&nbsp;MATILAN Security Services GmbH may withhold the completion of a service until its\nfee claims are fully satisfied. Complaints about the services of MATILAN Security\nServices GmbH do not entitle the client to withhold due fees.<\/li>\n<li>The place of fulfillment and jurisdiction is, unless otherwise agreed in writing by the contracting parties, the competent court in Austria, Vienna, 1st District.<\/li>\n<\/ul>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element
